I have a rental unit in Chula Vista, CA, that was rented to a Smoke Shop, resulting in a code violation (5.66.020 (CVMC)) for commercial marijuana activity. The Financial Credit Network is suing me to collect a $55,000 penalty. I have proof of the lease agreement, but the Financial Credit Network has witnesses claiming the renter was involved in commercial marijuana activity. Who is responsible for the penalty, the renter or the property owner, and what are my options for defending against this lawsuit?
