The mother of our three-year-old daughter is still legally married to her high school sweetheart who was deported several years ago. My daughter has been in a new daycare for 6 weeks. The director has cited normal toddler behaviors such as shoe removal, refusal of diaper change, and crying as reasons for not being able to provide service. The director suggests my daughter needs a paraprofessional to continue attendance due to her speech delay, which is considered a developmental delay. Is the daycare violating the ADA by offering feedback that they cannot meet her needs and she requires a paraprofessional to continue in their care? Additionally, do I have the basis to ask for a refund of the deposit and unused time in the month if I'm not comfortable leaving my daughter in their care anymore?
