Hello legal eagle, this is Aimee’s husband Jonathon. Aimee passed away on November 26th 2023 due to cancer, and she never got back to you. I need to start the trust now since I'm the only one left of the two of us. Our three properties, vehicles, and bank accounts are now in probate. Can you assist me in setting up the trust?

We recently discovered that a contractor in Missouri is using our original logo and business name, which we are based out of Pittsburgh, PA. They are also a concrete contractor. We have tried to contact them and asked them to stop using our logo, but they refused and claimed they made the logo themselves. We know this is false as we personally created the logo less than a year ago using a photo of our original concrete work. We have not registered our logo and business name as trademarks with the United States Patent and Trademark Office (USPTO). What can we do about this?

When an amended brief is denied and struck from the court record, how long should the court keep the denied amended brief, and is it still part of the court record? Additionally, can the court strike the denied amended motion from the record without the permission of the appellant, especially when a motion for reconsideration has been filed and the judge's decision is based on the amended brief? What should the appellant do if the judge strikes the amended brief, potentially destroying evidence that could correct major deficiencies in the original brief?
