I purchased a house with a repair contract that specified flashing would be installed above windows, doors, and trim, as indicated in the inspection report. However, at the deposition, the opposing counsel argued that flashing was only intended for the gate posts, causing confusion and a potential loss in settlement value. My attorney, who was supposed to be an expert, seemed unprepared and did not have the necessary expert witness present. Who is at fault for not pursuing the 'self-flashing' issue, and why wasn't the contractor, who was supposed to be our expert witness, present at the deposition? Additionally, does the repair contract and inspection report match, and why was there so much confusion during the deposition?
