A Board VP of our HOA took it upon himself to repair the tennis courts without discussion or approval from other Board members, resulting in damage that requires resurfacing. Can he be held liable for damaging the Common Property as written in the Declaration? Additionally, if other Board members decided as a majority without involving me as a Board member, can they be held liable for the pending repairs because they were acting in bad faith by trying to cover up the fact that they already paid the initial contractor in full that they hired, but are no longer in business?

The Board Treasurer of our HOA stated a contractor was not paid in full for incomplete repairs of the tennis courts, but I have documentation proving otherwise. The contractor is now out of business, leaving the HOA out $8K. Can the Board Treasurer be sued for $8K and any additional costs to complete the tennis court repairs since he hired the contractor and approved payment prior to completion?
