I recently purchased a third-floor condo in a gated community in College Point, New York, and decided to inquire about installing a stair lift. I contracted with Gem Restoration Services, gave them a $14,000 deposit, and later discovered that the stair lift would not meet the required egress law and would not be approved by the Board. The contract states that the order cannot be canceled once placed and the first payment is to be fully retained by Gem if the installation is stopped by the purchaser. Since I was not informed of the law at the time of the contract, am I liable to lose this money, and what are my options?
