I rented a retail store where a fire rendered the strip mall untenable. The local village authority closed all the stores, and the property has not been renovated six months after the fire. My lease term is from May 1st, 2010, to April 30th, 2013. Is my lease terminated, and do I have any right to go back into the property when it is ready? There is a Fire and Casualty clause in my lease stating that if the Premises are rendered untenable by fire, explosion, or other casualty, the Lessor may terminate the lease or repair the Premises within sixty days. If the Lessor does not repair the Premises within this time, or if the building is wholly destroyed, the lease shall cease and terminate.
