Is it possible to determine if a recent work interaction is considered retaliation after submitting a Short Term Disability (STD) claim in North Carolina? The interaction involved leadership approaching me to ask if I wanted to step down from my role and requesting a response before going on leave, which occurred the day after I submitted the STD claim. I have a pending civil lawsuit against BMW in Los Angeles. My attorney of record opened the case and then withdrew because the case was beyond his scope and expertise. How can I assist you this time? Last time we chatted it involved a civil rights suit. Here's what you need to know. It is considered Cruel and Unusual Punishment which is prohibited by the 8th Amendment to the Constitution, for an inmate to be denied adequate medical treatment. So if you had a serious condition for which you needed immediate care and Corrections did almost nothing at the expense of your health and safety, that would be grounds for a law suit. The toughest part of suing the county is finding a lawyer who will take it. Many local lawyers feel, rightly or wrongly believe that their practices will suffer if they take up a case against the local powers-that-be. You may have to spread a wide net into neighboring counties. If your case is good enough, however, some lawyer should be willing to take it. I'm not sure what you wanted to know this time around.
