I was fired from my part-time job at Cardinal Health, a large public company, for losing three phones in a 12-month period while out on deliveries. My employer did not contest my unemployment claim, but the EDD contested it on the grounds of misconduct, leading to a disqualification from unemployment benefits until I earned the equivalent of 5 weeks' benefits. I lost the appeal despite my belief that the case law was in my favor. I signed a separate agreement, which was signed by all other drivers, agreeing that losing three phones in a year would result in termination. When I went to the appeal hearing, I expected it to be just myself and the EDD, but Cardinal Health was there with an attorney, and I feel I was out-lawyered. Do I have a good case, and what could be the potential outcome?
