In a decision and order, the judge used a quote from an unsigned deposition to form a basis for why my case should remain defaulted. I argued that this deposition was improper as it was never provided to the deposed to verify. Opposing counsel argued that it lacks merit for appeal because it was not objected to at the inquest hearing. Is the decision still appealable?

I had an attorney last May who completed his job, and our business ended last month. I tried to get a court date for a hearing to receive a hardship license, but the judge's secretary said a date is pending and waiting for my attorney's response. I told her I no longer have an attorney, and she said they sent a notice to the last attorney on record, and I need a letter from them stating their law firm no longer represents me. I don't understand why I have to do this, and the previous lawyer is taking a long time to write this letter. Time is short for me in this matter, and they have dragged it out for 2 months with no end in sight. What should I do? I feel I'm being unfairly treated because I can't afford an attorney. This is in Warrick County, Indiana.

About two months ago, a drunk driver hit a power line, causing a surge that damaged my treadmill, costing me $500 in repairs. My homeowner insurance has a $1000 deductible, and the driver's insurance states they cannot cover the extensive damage to the community, with any settlements likely to take 10 to 15 years. I am 65 and on a fixed income, and my wife is on Social Security. If I take this to small claims, what is my best chance for success?
