In a MN civil case, the plaintiff pocket filed a suit against me in November 2012. I timely responded with an answer and discovery requests, but the plaintiff failed to respond adequately to my requests. The plaintiff has not yet filed the suit with the court. What would be the appropriate response to compel proper discovery responses without effectively forcing the plaintiff to file the suit?

A security company placed a boot on my vehicle with a note saying it would be towed in the morning. When I called them the next morning to remove the boot, my truck had vanished along with the boot (according to the security company, it had not been towed). I made a police report that morning. Coincidentally, even though security says they didn't tow it, they found it across the street in another complex with the boot in the back seat. I ended up having to pay $250 to get my truck from the towing company and then called security three times to give them the boot with no response. Now the security company is trying to sue me, saying I still have their boot. What can I do?
