In California, does the Supreme Court ruling on what's allowed in Anti-SLAPP motions take away the ability to cross-examine based on hearsay? Specifically, if affidavits are used in Anti-SLAPP hearings, must they be cross-examined if the defendant objects, and is there case law or code to support this?

I received a citation for CA VC 23114(e)(4) in September 2009 marked as an infraction, but in January 2010, I received a notice to appear in court for a misdemeanor charge of the same violation. The CA Vehicle Code states that a second or subsequent violation within 2 years of a prior violation is a misdemeanor. Why was I charged with a misdemeanor, and how can I plea it out to an infraction?
