I had a DUI in Pennsylvania. At the Preliminary Hearing, my attorney inquired about ARD for this case, and there was no objection from the prosecutor or arresting officer. I have priors of DUI from less than 20 years ago, including one non-conviction due to ARD and one guilty plea to a first offense. Despite this, they are still willing to possibly give ARD for this recent arrest. Do you believe the prosecutor knew my criminal history at the preliminary hearing, and what happens if the prosecution fails to provide discovery?
