My attorney's family is very sick, and he is out of town to take care of them, so he did not appear in court to represent me for the last 2 months, and the court may dismiss my case because my attorney has not appeared in court. I filed the Statement case management in pro per. Will the judge accept it? Do I need to send the proof of service to the defendant's attorney, my attorney, and the court? Can I use my sister to file the proof of service?

I received a judgment on a husband and wife that did not pay their rent. The judgment was from 1/9/04 for $9,500. Can I still file for 'Application and order for appearance and examination' to get them back into court? I have the form and it appears to require a date to be set by the court for the hearing before I serve them with the notice. Unfortunately I am in Missouri now.
