I have a case where the buyer of my house is suing me, claiming I stated there was a 'snake infestation' after closing. I have evidence proving she caused the issue with structural removals in wetland and stream buffer zones, possibly unpermitted bush removal in a wetland buffer zone, and that her claim is filled with untrue facts. They are now moving to transfer the case from small claims to civil court. I am looking for answers on what this motion process is about, if I get to present my facts, and if I can file a motion to dismiss so I can get my facts heard. Her lawyer knows my realtor, and I believe he doesn't have all the facts. Do I get to show my evidence at the motion hearing?
