My father recently passed away, and I lived with him in an apartment next door. I knew he had some policies, including a state policy for teachers that could cover his expenses. The beneficiary on the paperwork is his brother, but the state policy mentions next of kin, which would be me and my sibling. The brother is the executor, and I am the administrator, but he has informed me he is kicking me out of the home and not using the proceeds to assist the estate. I feel this was elder abuse because my father was in early dementia, and the brother is holding up the payment for funeral expenses. We are the estate and named, but the funding is going to a person who is not working in my favor. We have no standing to fight this even though SCPUBA says next of kin, which would be the children. What are my rights and how can I address this situation?
