I sued 4 defendants. One used her umbrella insurance to cover, one represented himself, and two ignored my lawsuit. As a landlord in the process of evicting a tenant, I need advice regarding the final steps to take. After the tenant responded to my lawsuit, the El Paso County Colorado Combined Court sent a notice for mandatory mediation to both parties. During the mediation, we agreed that the tenant would have an extra month to vacate the premises and I would waive any pursuit of payment for the $5,800 owed, provided they pay the rent for one final month. The agreement was legally binding and signed by both parties, and stated that failure to vacate by the given date would result in the case being backdated and a writ of restitution being filed. Unfortunately, despite the agreement, my tenant has made no effort to leave or pack their belongings. If they're not out by Sunday evening, I plan to file for the writ on Monday morning when the court opens. My question is whether or not I can file a motion for contempt of court on the same day, and if it's likely that the judge will act upon it.
