My spouse received a judgment against her from a credit card company for $10,000. She received a "Notice of Rights to have exemptions designated". She owns a rental house valued at $70,000 with a $20,000 line of credit. The house was owned before we were married, but I think under NC law I am also part owner. Can this house be counted towards the $35,000 exemption since it is a rental property and not her primary residence? If it can, would it increase to $70,000 since we are married? Lastly, can the attorney for the credit card company force the sale of it or just put a levy on it?
