We are a small business being sued for trademark infringement in federal court. We intend to settle and are close to a solution. However, the deadline to serve our Answer is approaching. We need to know: 1. If we serve the Answer via email and post mail to the opposing counsel on time, do we also need to file it with the court to avoid a default judgment? 2. Can we file the Answer with our local federal court instead of the distant one where the case was filed? 3. If we can't file it locally, can we file it via fax or email since we're not set up on the ECF system? 4. Should we file for a dismissal of the case since it was filed in the wrong county? 5. Can we file a motion for a Change of Venue via our local court, mail, or fax?

I have a right of way through my property with two creeks running through it. The people who use it asked to add gravel at the creek to make it easier to get in and out, which I agreed to. After heavy rains, the gravel was washed away. Now, someone has built a dam on my property to repair the damage, which I fear will change the flow of the creek and cause further damage to my property. Is it within my rights to have this removed and another solution used to solve the problem? The right of way was a verbal agreement when I first bought the property, and I live in Missouri.
