We want to write a motion for summary judgment, declaring the plaintiff has no case, based on the fact that he co-signed the student loan, there is no written agreement that payments made by him would be repaid by the defendant, and that he 'gifted' the payments verbally on many occasions to the defendant. Hello. Yesterday I was under the influence of Lexapro and had a severe reaction to the drug. I was unable to see, hear clearly, or move my body. I motioned to my girlfriend who was sitting next to me and told her to take me to the hospital because I was losing consciousness. Her family refused to allow her to take me to the hospital, causing me to black out and awake later in my home unaware of how I got there or what had happened. I am now suffering from severe migraines and swaying when I move. Do I have grounds for negligence under TN state law?
