In California, after serving a letter of intent to sue to a defendant, which preserves the statute of limitations for 90 days, if I can't find a lawyer to take the case, can I still file a small claims complaint within the 90 days or does it need to be within the original statute of limitations of 1 year?

As an Independent Contractor in Los Angeles, California, I am hired to provide a specific therapy modality to clients on an hourly basis. The company has a 48-hour cancellation policy where they bill 100% of the session cost for missed appointments. I am informed that I can invoice for the missed session but will 'owe the company that hour' for clerical work. I disagree with this policy and want to know my legal rights to refuse this arrangement and what I can say to the company to assert my rights.
