When someone dies without a will or executor and has outmaxed credit cards, are the children liable for making the payments? Additionally, if one sibling closed the deceased's bank account and the bank said the money would go to the government, is there anything the family can do to collect the money for cremation? Can they collect money from CPP for cremation? If the deceased had no assets except for a closed checking account and lived in a seniors home, are family liable to pay the August rent? If the daughter keeps using the deceased's credit cards and opens new credit cards, is this considered fraud and could she go to jail?

In a New York state foreclosure matter, where a mortgage debt was accelerated and a foreclosure notice was received in 2009, followed by a separate foreclosure action in 2017 with the same lender/servicer for the same mortgage, is the information and citation regarding the statute of limitations still legally relevant as a part of my defense, given that the six-year Statute of Limitations begins to run on the entire mortgage debt once it is accelerated?

I am involved in a legal dispute with a servicer acting on behalf of a Home Equity company. They have added legal fees to my case, and I am seeking to have them dropped. Additionally, they attempted to foreclose on me, and I filed a lawsuit in small claims court in Texas for not responding to Qualified Written Requests (QWRs). The case was moved to federal court, where I am now representing myself. I am considering dismissing my case in federal court and filing in small claims court for the legal fees only. What are my options and arguments for getting the legal fees dropped, and how can I proceed with my case?
