If my ex-spouse has stated in writing that he intends to default on our joint mortgage if we are unable to sell it by March 2010, can I take him to court and sue him to perform or at least force him to consider a short sale? According to our divorce agreement, he is financially responsible for paying the mortgage, taxes, insurance, and upkeep. We have a tenant whose lease is up in February, and they have first right of refusal but are experiencing financial difficulty. My credit will suffer along with his, and I make much less than he does and have 3 kids and rent to pay. He has stated he is losing too much money and will not pay the mortgage by that time if we cannot sell. What are my options and how much would it cost to pursue this legally?
