My small grassroots group received a 1099-MISC form and I don't know how to file it or if we should have even gotten it. We qualify for automatic tax-exempt status and may become a 501(c)(3) in the future. I tried to file a 990-N postcard but the system didn't recognize our EIN. I looked at the 990 form and don't know how to fill it out because we don't have most of the information it asks for. The 1099-MISC was for a donation, not compensation. Will filing a 990-EZ form force us to pursue 501(c)(3) status if we're not ready?

I am the legal guardian (custodial parent) of my daughter and son. My children's father and I live together and are both eligible to claim the children. I agreed to let him claim the children. If he does not claim the earned income credit for the kids, can I claim the earned income credit even though he is going to claim the kids as dependents, get the child dependent care credit, child tax credit, and additional child tax credit, and file as head of household? We were never married.
