I left the USA in 2000 and returned to New Zealand. Upon returning to the USA in 2005, I discovered the IRS had filed a fraudulent tax return for me in 2000, resulting in a $14,000 tax liability. After ten years of dispute, the IRS admitted their error and stated they owe me $9,856. However, they refuse to pay this refund, citing the three-year deadline for claiming refunds has passed. Given that the IRS filed the return fraudulently and I only learned of it recently, should the 'claim clock' start from when I discovered the error, and is there any way to recover the owed refund and compensation for the damages caused by their actions?
