A client loaned their sister $50,000 to help her get out of financial trouble. The sister claims the money was not a loan but a gift. What recourse does the client have? If he can get a judgment in small claims court, could he garnish the sister's wages? Could he put a lien on her house? What would you suggest, and the least amount of cost? What would an attorney charge to get this $50,000 back?

My partner backed out of our agreement after 10 days, claiming the 10k he put in is now a loan. The agreement was based on my experience and his financial and credit background. He was supposed to open a merchant account and handle accounting and taxes, but he never followed through. The company went out of business due to his failure to fulfill his part of the deal. Do I owe him anything since he now claims the 10k is a loan?

I'm a Massachusetts resident who was served a summons on July 9, 2012 with 20 days to respond regarding a $20,000 credit card debt charged off by Capital One in 2008. I ignored it and now received a copy of the plaintiff's request for Entry of Default. If I file an answer past the 20 days, will it hold up? Should I pay $1000 to stall court proceedings, or consider filing Chapter 7 bankruptcy?

I was cited for failure to obey a stop sign, pleaded not guilty, and now have a trial. Should I get a lawyer or represent myself? Can the cop cite me if he wasn't there? What if I can't afford a lawyer? How do I prove the cop wasn't there? What if I have a witness who saw the same thing I saw? Does the citation carry jail time if found guilty? What is the punishment for that? How long will it stay on my driving record? Will it affect future employment? Can I get it removed from my record, or do I just have to deal with it? When do I ask for a deferred judgment?

If a sales representative's customer has filed for bankruptcy, does the company have the right to revoke $7,000 of commission which has already been paid to the sales rep, especially if the company has not yet received payment from the customer?
