I had my case dismissed based on a failure to respond to interrogatories. Is that something I can challenge using Rule 60(b)? The judge didn’t specify if the dismissal was with or without prejudice, and the defense dragged it out for three years, potentially past the statute of limitations. The docket still shows my case as “open.” Can I file my response to the dismissal or am I barred now for good?

Good morning Sarah, I am following up on our previous conversation about Terminix regarding my daughter’s rat infestation. Remediation was done with no satisfaction, and my credit card company is in the investigative process. I’ve also sent a letter to Terminix chronologizing events this past year and voicing my dissatisfaction with their service, since the problem is worse than ever.
