I received a letter from law firm Rubin & Rothman, LLC, notifying that Midland Funding of Delaware LLC has obtained a judgment against me for a debt I never owed. I previously notified Midland Funding LLC that the account was fraudulent and requested verification documents, which they failed to provide. Despite this, they obtained a judgment against me. Is it legal for Midland Funding LLC to pursue further collection activities without verifying the alleged debt? Doesn't the FTC or FDCPA prohibit collection activities on an alleged debt account without complete verification if a dispute is filed by the consumer? What can I do to fight this case, and how can I request to vacate the judgment? How can I prove that I was not served a summons with proper proceedings?

My friend who died had an account with Dreyfus. I am the legal representative of my friend. I sent Dreyfus the Certificate of Death, Copy of Last Will and Testament, Copy of W-9, Account Statement, and my driver's license, asking them to send me the balance of the account.
