If we were not the original image poster, just reposting, are we still responsible to pay compensation for the use of Associated Press' photo?

My husband was charged with a DUI in Feb 2018 and has since been on probation due to missing court dates and failing to complete the ARD program. He is 63 years old, has a failing memory believed to be dementia, and is in no physical shape to go to jail. We are awaiting a court date and have an appointment with a neurologist and a rehab evaluation. Our attorney is unresponsive. What can we do to get him back into the ARD program, and is it possible for him to be allowed back into the program if diagnosed with dementia?

Additionally, if I was offered a severance deal to waive any future claims, can I negotiate for more severance by threatening to report workplace violations, and would this be considered blackmail or protected under whistleblower laws?
