My boyfriend and I have been paying on a car loan financed in 2012 with few missed payments in the first year, but we haven't touched the principal. We are concerned we never will, especially since we have made three years of on-time payments and still owe the same amount we financed. We are in California, both veterans, and the loan is through Santander Bank with a variable interest rate. We want to know if this is legal and if there are other options. The loan has negatively impacted our credit scores and we feel trapped due to being upside down on it.

Is it possible for the court to strike the late response, and if the opposing party shows up to defend the OSC, does it mean they forfeit the right to demand personal service?
