When do you have to disclose evidence in a trial? I have a situation where an estate planner created a power of attorney in my name at my grandfather's request years before I ever met the guy. The estate planner was also the witness to the document. I didn't know it existed until recently, at least this version. The one I signed was effective upon disability, but the one I just came across had a different front page, making it effective immediately. The estate planner replaced the original document with another one with a different witness. I have the original copy of the power of attorney. Do I have to disclose that I have the original copy when I file the petition, or can I wait until he denies doing it before I present it?
